Brazil's Central Bank draws the line between fund transfers and self-custodial wallets
Brazil's Central Bank recently drew a new regulatory line between customers 'deposit of funds and the departure of funds or transfer of funds to self-custodial wallets. Starting from January 1, 2027, large transfers will face a mandatory waiting period.
New rules and regulations: Applicable objects and effective time
According to Resolution No. 584/2026 issued on August 7, 2026, encryption service providers must freeze specific customer transfers for up to 24 hours before processing them. The central bank said the move was because cryptocurrencies, including stablecoins, have been used to transfer funds derived from financial fraud, but victims or relevant institutions often have no time to recover it.
Detailed explanation of the rules: Which transactions are affected?
This freezing mechanism is activated when a customer deposits fiat or cryptocurrency to an exchange and subsequently attempts to transfer funds equivalent to more than US$10,000 to a self-managed wallet or overseas crypto platform. This threshold applies to a single transaction and also applies to the cumulative total of multiple transactions within the same day. Transfers below this threshold are not automatically waived-such transactions must also be suspended if the provider's internal risk system issues an alert.
After a freeze occurs, the provider must inform the customer of the reason for the suspension and its duration. The maximum limit is 24 hours instead of a fixed waiting period. If the internal review finds no suspicious circumstances, the provider may lift the freeze in advance, but the decision needs to be recorded. After 24 hours, the company must complete the transfer or refuse it. Under normal circumstances, the freeze shall not be extended after this time limit.
Providers also need to evaluate four factors for each flagged transfer: the customer's risk profile, the nature of the transaction, the identity of the recipient, and the jurisdiction where the recipient is located. The central bank said the measure was purely precautionary and was not intended to permanently freeze customer assets.
Penalty for violations: Consequences of gradual escalation
Companies that fail to comply will face gradually heavier penalties. The central bank can require it to implement a freeze for more than 24 hours, extend the freeze requirement to transfers below $10,000, or revoke its authority to lift the freeze early. The resolution amends the 2021 anti-money laundering framework for payment institutions and requires companies to record in detail encryption fraud incidents and the control measures adopted on a daily basis.
Regina Pedroso, chairman of the Brazilian Tokenization Association Abtoken, told local media that the policy could increase costs for legitimate users and could put domestic exchanges at a disadvantage when competing against foreign competitors who are not bound by Brazilian rules.
Regulatory background: Brazil's crypto framework continues to improve
This new regulation is part of Brazil's broader regulatory framework around cryptocurrencies. The requirements, which take effect in February 2026, stipulate that crypto service providers operating during Brazil's regulatory transition period must be formally authorized and must comply with governance, security, anti-money laundering and counter-terrorism financing standards. Previous frameworks have included stablecoin transactions anchored to legal currencies and some international crypto transfers within the jurisdiction of Brazil's foreign exchange rules.
According to the 2025 Global Cryptocurrency Adoption Index released by Chainalysis, Brazil ranks fifth. Between July 2024 and June 2025, Brazil received a total of approximately US$318.8 billion in cryptocurrencies, which accounted for approximately one-third of all crypto activity in Latin America during the same period.
