The leadership change follows a high-profile failure in crypto market regulation. About a week ago, the Senate narrowly rejected the Clarity Act, which was designed to establish broad market regulatory rules for the digital asset industry. The vote to advance the bill was 49 votes in favor and 50 votes against, falling short of the 60-vote threshold needed to end the debate. Four Republican senators opposed the measure, with no Democrats supporting it.
The bill was criticized after a last-minute revision that removed exemptions for software developers from 18 U.S.C. 1960 Clear protection of criminal liability. Jason Somensatto, policy director at the nonprofit research firm Coin Center, criticized the revision as "deeply disappointing."
Mursinger expressed pride in the progress the association has made: "I am proud of the journey we have traveled together, from the GENIUS Act to achieving true regulatory clarity in the SEC and CFTC," noting that Smith "built the association from scratch."
In addition, eighteen state attorneys general, led by New York Attorney General Letitia James, warned that the Clarity Act could weaken enforcement of state-level fraud.
Smith called her return to leadership role "very meaningful" to her and emphasized Mursinger's service contribution at critical moments in the crypto industry.
