The bill also contains 16 provisions that target illegal financial activities, including requirements of the Bank Secrecy Act and the Anti-Money Laundering Act that aim to address cryptocurrency money laundering, and establishes special considerations for developers and verifiers of decentralized finance (DeFi).

Urgent legislative window

The bill passed the House in May 2026 with a vote of 294 to 134 and passed the Senate Banking Committee with a vote of 15 to 9. But the road to eventually becoming law is still narrow. Time is one of the main challenges. If the Senate fails to act before its August recess, progress of the bill could be extended until 2027, making July a key month for Washington's digital asset policy.

Republicans may need the support of at least seven Democratic senators to break the Senate's 60-vote approval threshold. Outstanding issues include ethics related to President Trump's crypto business and how the crypto reward program should be handled. Loomis emphasized urgency from a competitive perspective, warning that without the CLARITY Act, other countries will fill the regulatory vacuum and set standards that may not be in line with U.S. interests and values.

The European Union has launched the Cryptographic Asset Markets Act (MiCA) framework, and Singapore has continued to roll out a regulatory red carpet for digital asset companies for many years. If the United States lacks a unified regulatory framework, international regulatory standards may be formed without the participation of the United States.
