On July 20, 2026, Chief Minister Devindra Fadnavis formally reviewed the proposed legislation at a government meeting in Mumbai. Government officials were instructed to develop the regulatory structure needed to support the DELTA Act. As many legal and compliance elements have yet to be resolved, relevant work is still advancing.

The legislative proposal aims to codify standards for the creation and transfer of blockchain tokens representing real estate. The framework aims to provide legal clarity while protecting property rights during digital transactions. In addition, the initiative also solves the current problem of asset liquidation that lacks liquidity.

The state government expects that real estate tokenization could activate approximately 50 trillion rupees (approximately US$595 billion) of underutilized assets. Officials see the DELTA Act as a cornerstone of their economic expansion blueprint. The plan directly helps Maharashtra achieve its goal of US$1 trillion economy by 2030.

Panel designs DELTA Act structure

Fadnevis directed the urban development department to jointly convene a special advisory group with the legal and judicial departments. The committee will build the comprehensive legal infrastructure to support the DELTA Act. Panel members will include representatives from the Securities and Exchange Board of India (SEBI), Bombay Stock Exchange (BSE), National Stock Exchange of India (NSE), as well as legal professionals, financial advisers and blockchain technical experts.

Committee members will determine how blockchain real estate tokens operate within the Indian legal system. Key determinations include whether the token constitutes a title document, investment instrument, income right or regulated security. These classifications will determine transaction agreements, custody standards and regulatory frameworks.

The advisory group will study international precedents and operating frameworks before finalizing legislative recommendations. The DELTA Act must be harmonized with federal regulations covering property registration, fiscal policy, securities laws, foreign investment requirements, and financial crime prevention measures. Once passed, the legislation will become India's first state-level regulation specifically targeting blockchain-based real estate tokenization.

Real estate token initiative broadens digital asset discussions in India

Blockchain tokenization converts property-related interests into digital tools maintained on a distributed ledger system. Proponents expect this to speed up transaction processing, provide verifiable ownership documents, and enhance fractional ownership possibilities. A divisible ownership structure may make investment in quality real estate more democratic.

Blockchain infrastructure alone cannot eliminate property rights disputes or correct defective land documents. Therefore, regulators must establish a legally binding connection between digital tokens and government property databases. The regulatory framework must also cover inheritance planning, loan arrangements, restricted property, document restoration, fraudulent activity, and conflicting property claims.

This legislative initiative comes amid extensive discussions around real-world asset tokenization in multiple policy channels in India. GIFT City (Gujarat International FinTech City) has promoted regulated tokenized real estate vehicles under current financial regulations. At the same time, the Reserve Bank of India maintains a restrictive policy on cryptocurrencies while recognizing the broader uses of blockchain. The DELTA Act could advance India's tokenization infrastructure by providing legal legitimacy for blockchain property documents while maintaining existing legal guarantees of land ownership.
