Black Swan Capital co-founder remains optimistic after the delay in progress of the U.S. Clarification Act.

As doubts about the delay in progress of the U.S. Clarification Act continue to emerge, Black Swan Capital co-founder Van der assured investors that this development has not changed his long-term view of the digital asset market.

He further explained in a tweet that his investment logic never relied on the bill to become law within a specific timetable. Instead, he believes XRP investors should focus more on what the bill is designed to achieve and maintain realistic expectations about how the bill's final passage may affect the crypto market.

Regulatory clarity removes major obstacles

Vander describes the Clarity Act as legislation designed to establish a clearer regulatory framework for U.S. cryptocurrencies, digital assets, blockchain companies, exchanges and token issuers. He pointed out that uncertainty over whether digital assets should be classified as securities or commodities has caused confusion for investors, companies and financial institutions for years.

He said that this lack of regulatory uncertainty has prevented large institutions from investing large amounts of money in the field, as companies often enter emerging technologies after a clear legal framework is in place. In his view, the bill will provide the necessary certainty for long-term infrastructure development, innovation and broader institutional participation in the digital asset industry.

Responding to the recent delay, Van der pointed out that lawmakers have postponed further consideration of the bill until after the Senate's August recess. Although public reports attributed the delay to controversy over ethics provisions involving public officials and digital assets, he believes lawmakers are simply buying more time to move the bill forward. Regardless, he still expects the bill to eventually pass into law.

Investors should not expect the market to shift immediately

Although Van der believes that the Clarification Act will ultimately benefit the crypto industry, he warns against assuming that the bill will immediately trigger a continued bull market. He says investors often confuse the long-term impact of regulatory clarity with the short-term reaction of financial markets.

Based on his experience studying market behavior, he suggests that institutional investors tend to be positioned before major news. As a result, he believes that any excitement after the passage of the bill could initially trigger a strong rally, while also providing liquidity for early participants to choose to reduce their positions. Fandel stressed that agency money will not flood the market overnight because of the bill. He explained that large financial institutions must complete legal reviews, compliance processes, investment committee approvals, custody arrangements and operating planning before deploying large amounts of funds.

He also pointed out that regulation alone cannot create the liquidity needed to drive long-term market expansion. Instead, he believes that the most favorable environment for digital assets will emerge when regulatory clarity coincides with loose monetary policy, improved financial conditions, and liquidity expansion.

Vander concluded that this combination will lay the foundation for institutional investment growth in blockchain infrastructure, tokenization, stablecoins, digital payments and practical cryptocurrencies. Although he expects the Clarification Act to eventually pass, he believes its greatest impact will be felt over time-when regulatory certainty and favorable macroeconomic conditions work together to encourage a wider range of institutions to participate in the digital asset industry.
