In the basement of the Capitol, negotiations continued until the vote began. A Democratic staff member told Crypto In America that Tillis was willing to postpone the vote to continue negotiations, but a staff member for Senate Banking Committee Chairman Tim Scott (R-South Carolina) abruptly interrupted the conversation without explanation.
The breakdown of negotiations quickly triggered mutual recriminations from both sides. Republicans accuse Democrats of never really seriously considering passing the bill; Democrats accuse Republican leaders of forcing a vote ahead of unfinished negotiations in order to preserve what one staff member called Trump's "hoax."
Senator Cynthia Lummis, Republican of Wyoming, the bill's main architect, said: "Senate Democrats have proved they have never been truly committed to protecting consumers and maintaining America's lead. I sit at the negotiating table with Senate Democrats, working in good faith to get this task done, and they are playing tricks."
However, some Democrats who voted against the bill insisted that the bill was not over. "It's not going to die," Senator Angela Alsobrooks, D-Maryland, said immediately after the vote. Do you know why? Because more than 70 million Americans are involved in an unregulated industry, we have a responsibility to regulate it."

Securities and Exchange Commission Chairman Paul Atkins clearly linked the agency's new innovation exemption to the failure of the Clarity Act to advance in the Senate. The SEC released much-awaited measures on Thursday that opened a path for tokenized U.S. stocks to be traded on the floor, and the industry is once again kindled with new excitement as regulators move to take over the lead.
The Commodity Futures Trading Commission (CFTC) is also actively promoting it. Its staff issued a non-enforcement position against passive software providers, while the agency submitted a broader crypto market rulemaking proposal to the White House for review. Details of the proposal have not yet been made public.
The industry is gaining clarity in some form. For now, this clarity will be presented in the form of a lower-case "c" provided by regulators rather than Congress.
