ESMA will prioritize strengthening EU-wide AI and tokenization regulation in 2027

The European Securities and Markets Authority (ESMA) lists artificial intelligence and tokenization as a new focus for digital innovation regulation in 2027

Starting from 2027, the European Securities and Markets Authority (ESMA) will include artificial intelligence (AI) and tokenization technology as an initial focus among new digital innovation regulatory priorities. Across the EU, regulators will identify emerging areas of tokenization technology and document financial institutions 'use or plan to use AI and tokenization technology in products and services, especially those that directly affect investors. At the same time, regulators will conduct preliminary inspections of the most affected companies.

Building professional capabilities and unified regulatory approaches

ESMA said on Wednesday that the priority was established to help member state regulators build a pool of professional knowledge and develop a unified regulatory response strategy. This move is particularly necessary as financial institutions increasingly adopt AI technology and tokenized products in financial services.

This initiative belongs to the Union Strategic Supervisory Priority (USSP). ESMA uses such mechanisms to coordinate the work of national regulators to respond to risks that require common EU-wide attention. According to the information it released, the following risks need to be focused on: AI outputs biased or misleading, complex products that are difficult for investors to understand, and excessive reliance on a few third-party service providers.

Regular evaluation and innovation case sharing

Every three years, ESMA identifies up to two EU-wide priorities that reflect emerging trends and technological dynamics. In addition, regulators plan to review the way financial institutions disclose information about emerging technologies to investors and share innovative cases that can improve investor rights, reduce bias, and ensure the reliability of results.

Parallel to Other Regulatory Priorities

This new priority will be implemented in parallel with the existing USSP-the regulatory focus on network and operational resilience-launched in 2025. At the same time, ESMA will conclude another independent priority this year, namely special regulatory work on environmental, social and governance (ESG) information disclosure.
