Because the rule is in the pre-rule stage, the White House Office of Information and Management will review any proposal before entering the Federal Register for public comment. This means that crypto market rules are still in the draft stage of review, and details of registration, custody and market supervision are still to be determined. The filing provides industry participants with a concrete milestone to respond to long-standing calls for clearer federal rules on how digital asset markets are regulated. Still, the move further deepens the CFTC's influence in the crypto space, after the commission expanded the scope of no-action exemptions for passive cryptographic software providers.
