Despite revisions before the vote, differences remain on ethics, stablecoin provisions, banking issues and financial crime protection. Senate Banking Committee Chairman Tim Scott supports advancing the bill and said the Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC) should use existing powers to develop workable rules while lawmakers continue to work. Minority Leader Elizabeth Warren opposed the measure and called for further negotiations, noting that the bill covered issues such as national security, financial stability, consumer protection and ethics.
Garlinghouse's view: Technology is better than legislation
At a digital economy event held in Kansas City on September 15, Garlinghouse delivered a speech with the theme of "The Disruption of Digital Assets." He pointed out that existing financial infrastructure has failed to keep pace with new technologies. He believes that if you have better, faster, and stronger technology, this technology will usually win out of the competition.
Garlinghouse questioned why the United States would risk giving other countries an advantage because many G20 jurisdictions have established regulatory frameworks for cryptocurrencies. He emphasized that this represented his assessment of U.S. competitiveness rather than a formal conclusion from U.S. regulators. Previously, Garlinghouse had repeatedly called on Congress to advance the CLARITY Act and believed that if policymakers completed the U.S. regulatory framework, making the United States the main center of digital assets would still be "within reach."
Ripple's Statement on the Legal Status of XRP
After the Senate vote failed, Ripple issued a formal response, saying the result did not change its view of XRP's current regulatory status in the United States. In a September 15 statement, the company noted that it had spent more than $150 million in litigation with the SEC and cited previous court cases and subsequent federal regulatory guidance to discuss the status of XRP.
According to an interpretation document released by the SEC on March 17, XRP is classified as a "digital commodity" along with Bitcoin, Ethereum and Solana. The interpretation was jointly issued by the SEC and the CFTC, and the CFTC said it would consistently implement the Commodity Exchange Act based on the interpretation. However, it needs to be distinguished that this document is an interpretative opinion of the SEC and not a law enacted by Congress. The SEC itself has said the move is intended to complement Congress's efforts to develop a comprehensive market structure framework.
Ripple stated that despite the failure to pass the CLARITY Act, the company will continue to participate in the regulatory work of the SEC and the CFTC, and is confident in the classification of XRP as a digital commodity, while continuing to advocate the legislative process of incorporating federal cryptocurrency market rules into the law.
Market reactions and future prospects
As the legislative outlook is unclear, the crypto market has fluctuated. Bitcoin reportedly fell more than 5%, its largest one-day percentage decline since June. Shares of Coinbase and Circle fell as much as 10% during trading hours. In addition, leveraged positions suffered heavy losses. According to data, the exchange cleared approximately US$571 million in long-term positions within 24 hours, of which Bitcoin and Ethereum multiple positions each accounted for approximately US$190 million.
