California lawmakers passed a bill banning public officials and government employees from issuing Meme coins and sent the bill to Governor Gavin Newsom for a final decision. According to the bill's records in LegiScan, Assembly Bill 2409, introduced by state Rep. Valencia, passed the final legislative process on August 26-the Senate passed it with a 40 - 0 vote, followed by a 78 - 0 vote in the House of Representatives. The result agreed to the Senate amendment. The bill is in its final submission stage, awaiting signature or veto by the governor.

This bill adds a new chapter to the California Government Code that explicitly prohibits any public official or government employee from issuing Meme coins. At the same time, the bill also covers the scope of regulation to platforms that may place such tokens: Starting January 1, 2027, digital asset service providers will not be allowed to sell or purchase Meme coins issued after that date on behalf of federal, state or local public officials and their partners. State attorneys general, district prosecutors, city prosecutors and county legal advisers will be authorized to enforce the injunction through civil litigation, including seeking injunctive relief and recovering illegal gains.
Why did California act now?
The bill was introduced against the background that political Meme coins have cost ordinary buyers a heavy price. The TRUMP Meme coin launched by Donald Trump before returning to the White House ultimately wiped billions of dollars in market value-according to media reports, insiders took out about $4 billion, while nearly a million retail investors suffered losses. State lawmakers view AB 2409 as a measure to maintain public trust and distinguish public office from speculative token offerings, in parallel with federal-level discussions around the CLARITY Act and broader rules for crypto market structure.
The decision on the next step
The decision now falls to Governor Newsom, who has the choice of signing the bill into law or vetoing it. If the bill takes effect, the ban on officials issuing Meme coins and restrictions on platform listings will take effect in January 2027. For exchanges and digital asset service providers, the practical issue will be how to identify and screen Meme coins associated with current or former public officials. Until the governor makes a decision, the bill remains pending legislation rather than formal law.
