CFTC与SEC发出更严厉监管信号
According to reports, after the bill failed, both regulators stepped up their focus on the crypto market, drawing their respective positions independently rather than waiting for congressional mediation.
The CFTC has historically believed that most major cryptocurrencies, including Bitcoin and Ethereum, are commodities within its regulatory scope, while the SEC has a broader view that most tokens are unregistered securities. Both positions are valid in the absence of legislative mandatory compromise, and both agencies are backed by enforcement mechanisms.
Timing is crucial. Senator Loomis, the bill's leading advocate, has described the vote as a "life-and-death moment" for the industry. The failure of the bill left a gap in regulatory action and filled a vacuum that could not be covered by legislation.
How regulatory changes affect crypto markets and businesses
For crypto exchanges, token issuers and institutional investors, the practical consequence is continued exposure to multiple legal risks. A company registered with the CFTC is not necessarily immune from SEC action, and vice versa. This dual threat dynamic has affected the legal strategic structure of companies such as Coinbase.
The division of responsibilities between the SEC and the CFTC is exactly what the Clarity Act aims to address. In the absence of the bill, compliance teams would face an environment where rules could change based on which agency acted first.
Institutional investors are paying close attention to developments. The CFTC recently approved SGX's crypto perpetual futures products for U.S. institutions, a sign that it is actively expanding its influence in the field rather than backing down.
The next question is whether Congress will attempt another round of legislative push, or whether the two agencies will lock in any new bill by creating rules and enforcement action before it is put for a vote. What happens next may define the regulatory landscape in the next few years.
