The amendment attracted more than a dozen co-sponsors, including seven Republican lawmakers. At the core of the controversy is whether stablecin rewards will attract deposits to flow out of banks. The September 14 draft includes a "circuit breaker" mechanism set up by the Ministry of Finance to deal with large-scale deposit losses. Under the mechanism, the finance minister has the power to determine whether a significant loss of deposits has occurred, and the finance ministry will then formulate rules to limit the gains or rewards of stablecoins.
The CLARITY Act was significantly expanded during the negotiation process
The Senate version of the bill was significantly increased, from the original 275 pages to approximately 635 pages. The draft also adds provisions related to financial supervision. The draft retains the SEC's anti-fraud and market manipulation enforcement powers, and introduces the CFTC's rulemaking powers, best enforcement requirements, and whistleblower protection mechanisms. At the same time, provisions related to decentralized finance (DeFi) cover software developers, miners and verifiers. Ethics provisions have also been expanded to include restrictions on federal officials holding digital assets.
However, the Senate failed to move the bill forward on September 15. The procedural vote was 49 votes in favor and 50 votes against, failing to reach the 60 votes required for adoption. Reuters reported that four Republican lawmakers voted against advancing the measure.
Regulators move forward without new legislation
