XRP CLARITY 法案参议院终止辩论投票失败
9月15日，旨在为加密行业提供法律清晰度的《CLARITY 法案》在参议院未能通过终止辩论投票，以49票对50票的微弱差距落败，仅差11张“赞成”票。
Ripple首席法务官Stuart Alderoty对此公开回应，提醒社区XRP已经拥有明确的法律地位。他明确表示：“Ripple和XRP立足于既定的法律基础之上。”这一立场源于SEC与Ripple之间的诉讼案。法院裁定XRP不属于证券，该裁决具有法律效力，并不取决于国会是否通过或未能通过任何立法。

市场反应剧烈

XRP持有者在社交媒体上表达了不满。有评论者质疑，正如Ripple高管反复提醒的那样，XRP的法律清晰度究竟何时才能真正发挥作用？另一位评论者则认为，由于富裕利益集团往往以普通投资者的损失为代价操纵系统，因此所谓的“清晰度”毫无意义。
还有评论者挑战了“XRP拥有法律清晰度”的逻辑，指出资产的实际采用率并未反映这一点；另有人表示，机构资金在投入前需要完全的法律监管清晰度，并对所谓阻碍市场的政治干预感到沮丧。
监管机构已承诺行动
SEC主席Paul Atkins表示，该机构“已准备好、愿意并有能力出台相关规则”。CFTC主席Michael Selig在机构创新咨询委员会会议上做出了类似承诺，表示如果国会未能采取行动，CFTC将利用现有权力建立加密市场结构。
The SEC issued a proposal for the Regulation of Cryptoassets on August 18 and is currently in a 60-day public comment period. At the same time, the CFTC directed staff to explore rules for establishing a dedicated crypto asset market structure. Both regulatory agencies are actively promoting it. Alderoty believes that no matter how the final framework is formed, XRP is already in a good position.
XRP's legal status remains solid
The 2023 court decision gave XRP a legal basis that other major crypto assets do not have. Alderoty highlighted a joint explanation issued by the SEC and CFTC in March this year that classified XRP as a commodity. His view is that this foundation is more important than any single legislation.
