Protection mechanism built by Democrats
These protections were not obtained by accident. They were the result of more than a year of bipartisan negotiations. Republicans confirmed over the weekend that the final alternative text contained 126 substantive changes proposed by Democratic negotiators.
The ethics clause is significant. Federal officials and their spouses must now strip significant financial interests related to cryptocurrencies or place them in qualified blind trusts. The state attorneys general also gained enforcement powers, a concession the White House had previously resisted. President Trump agreed to the restrictions before the final text was released.
The cost of losing the vote
If the bill fails to pass, all Democratic amendments will expire. Self-managed protections will disappear,"best execution" requirements will disappear, and the Office of Retail Goods Advocates will no longer exist. Any version of the bill that contains these victories cannot be moved forward if it cannot garner 60 votes in Tuesday's closing debate vote.
The legislative agenda makes this situation even more urgent. The Senate will enter recess on October 5. House leaders have canceled meeting weeks on September 21 and 28. Loomis said the failure of the vote will likely delay comprehensive digital asset regulation until 2030.
Tuesday's decision
In another post, Loomis spoke directly to her colleagues before the vote. "U.S. leadership, true consumer protection, and giving law enforcement the tools they need to fight illicit finance" formed one side of Tuesday's vote; turning away and ceding regulatory control to other jurisdictions formed the other.
She bluntly explained what voting no would mean for the world: "No other country can regulate this industry as effectively as the United States." She wrote: "The CLARITY Act is right in front of us and this opportunity will not arise again for years to come. Let us win this victory and complete the task."
