A failed procedural vote did not cause H.R. Bill 3633 itself is invalid. Senator Thom Tillis subsequently filed a motion to reconsider, reserving the procedural path of another vote. The Blockchain Association said the avenue allows lawmakers to revisit the measure.
Mersinger said after the vote that the group will continue to engage with lawmakers from both parties. She also said the group would work with the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC). The statement framed agency action as an alternative path because congressional negotiations remain unresolved.
Senate process's setback to the CLARITY bill is reversible
Government Publishing Office records confirm that H.R. No. 3633 is the Digital Asset Market Clarity Act. The legislation would establish a federal regulatory framework for the offering and sale of digital goods. It also divides regulatory responsibilities between the SEC and the CFTC by activities covered.
Before the September 15 vote, Senate Banking Committee leaders released a revised text. Senator Cynthia Lummis said the final draft reflected more than a year of negotiations. She said lawmakers made 126 substantive revisions during the negotiation process based on Democratic demands.
Democratic opposition focuses mainly on issues of ethics, national security and financial stability. Senator Elizabeth Warren said before the vote that the bill lacked adequate protections in these areas. Republicans believe the proposal strengthens consumer protection and clarifies the agency's jurisdiction.
