How to detect errors: Four-step reconciliation method

Reconciliation is manual, but there are limits. Four steps are sufficient to produce reliable results:

  1. Check that the account is complete. List all platforms, wallets and agreements active during the tax year. Any forgotten account will render subsequent calculations worthless.
  2. Verify year-end balance. The closing balance of the previous year plus all inflows minus all outflows must equal the closing balance of the tax year. If the totals do not match, it means that a movement record is missing.
  3. Match each transfer. Each withdrawal from Platform A must have a matching inflow in the wallet or Platform B, including the matching amount and timestamp. Unmatched transfers are the main source of fictitious gains.
  4. Recalculate the top ten transactions separately. Errors rarely occur in a large number of small transactions. Please manually check that the price, quantity, fee and date of the largest item are consistent with the underlying data.

For the first three steps, it is very valuable to have a tool that can merge multiple accounts and automatically pair transfers. Our "Comparison of Cryptocurrency Tax Software and Combination Trackers" shows what procedures apply to the German legal framework and their limitations. The end result is still your declaration, not the output of the program.

Which value applies in case of doubt: acquisition cost, holding period and tax exemption

Before correcting it, you need to know what the correct result should be. For private investors, private disposal transactions as stipulated in Article 23 of the Income Tax Law apply. If sold within one year after acquisition, the proceeds are subject to tax; after more than one year, they are exempt. Revenue is equal to disposal revenue less acquisition costs and directly related costs.

Two values determine almost all corrections: the first is the combined annual exemption of € 1,000 for all private disposal transactions: if this limit is exceeded, all proceeds will be subject to tax, not just the excess. The second is the order of consumption of positions. The usual practice is to follow the "first-in, first-out" principle, that is, the earliest acquired unit in each wallet or account is disposed of first. If the method is switched over two years, a break will occur in the report.

When data is completely lost: Estimates are made in accordance with Article 162 of the General Taxation Code

Sometimes data cannot be retrieved, such as the collapse of an exchange. At this time, the tax bureau can estimate the tax base in accordance with Article 162 of the General Taxation Rules. Estimates are not blank checks from the authorities, but the results often go against you, and the burden of proof to prove the lower value then falls on you.

Therefore, it is best to estimate and disclose the estimate yourself. Record what data is missing, why it is missing, and how to derive the applied value (e.g., daily prices based on trusted sources on the blockchain that can verify transaction times). A reasonable self-estimate clearly stated in the cover letter is completely different from the numbers quietly filled in.

File retention period

Private investors do not have a universal retention period like companies do. What is important in practice is the evaluation period. For income tax, it is usually four years; five years when reckless tax cuts are involved; and ten years when tax evasion is involved. As long as the assessment period runs, the tax bureau can process the case, so you need to keep records during this period.

There are two groups of people who face clear obligations: those engaged in commercial transactions or mining are subject to account and record-retention obligations; and those with a calendar year surplus income of more than € 500,000 must keep basic records for six years under Article 147a of the General Taxation Code. For others, a simple rule of thumb applies: Download annual data for each platform at the beginning of each year and back up two copies. It took only a few minutes, while rebuilding it three years later would take days.

Report corrected, but return submitted: In accordance with Article 153 of the General Taxation Code

If you notice the error after your tax return is issued, separate regulations apply. In accordance with Article 153 of the General Taxation Code, once you subsequently realize that the return submitted is incorrect or incomplete and that this may result in underpayment of taxes, you must immediately notify and correct it. This rule applies as long as the evaluation period remains in operation.

"Immediately" means hesitation without any fault, rather than waiting until the end of the next year. In practice, you only need to send a short letter to the tax office, stating the corrected figures for the transaction, statement and attaching new documents. There is no need to resubmit the entire declaration. What is important is that the letter clearly states which has changed, how and why.
