The U.S. Treasury Department withdraws cryptocurrency regulation proposal, and industry wins privacy protection victory
The U.S. Treasury Department has officially withdrawn two proposed regulations aimed at strengthening surveillance in the cryptocurrency sector. The move marks a major shift in federal regulatory policy and has been highly praised by digital asset industry advocates.
FinCEN withdraws decision and industry response
On Monday, the Financial Crimes Enforcement Network (FinCEN) filed a notice announcing the termination of the 2020 rule for "unmanaged wallets" and a separate proposal for international cryptocurrency hybrid services in 2023. Both withdrawals will be announced in the Federal Register on Tuesday.
Privacy advocates and crypto groups were quick to welcome the reversal. Coin Center, a Washington-based digital asset policy group, described the move as a "major victory for financial privacy." Previously, the definition of "mixed currency" in the proposal was too broad, including regular privacy techniques used by ordinary cryptocurrency holders into the scope of supervision. The Coin Center pointed out that because FinCEN has difficulty clearly defining the nature of such transactions, prudent financial institutions may report even domestic activity, which can lead to innocent users 'accounts being frozen or closed, with unintended effects.
If the "Un-Managed Wallet" rule is implemented, banks and other financial institutions will be required to report cryptocurrency transactions exceeding US$3,000 and US$10,000 by customers in wallets hosted on non-exchange platforms.
Impact Analysis of the Mixed Currency Proposal
Fomo App
The Treasury Department's decision follows the guidelines of the President's Digital Asset Markets Working Group. In a July 2025 report, the working group wrote that the Trump administration prefers to allow legitimate users of digital assets to conduct private transactions on public blockchains and recommended that the Treasury Department reassess its approach to relevant regulations.
Although the report acknowledges that some criminals use currency mixers to conceal illegal activities, it also points out that these tools play a role in protecting the privacy of legitimate users.
Although FinCEN is withdrawing these proposals, the agency said it will continue to monitor money laundering and terrorist financing activities in the cryptocurrency space and take further action if necessary.
