The Treasury must establish a public cryptographic "Proof of Reserve" system and issue annual reports detailing reserve positions, transaction records, and control of private keys. The report will be verified by independent third-party auditors with expertise in cryptographic verification, while the U.S. Comptroller General will be responsible for ongoing oversight.

The revised version also instructs the Ministry of Finance and the Ministry of Commerce to study additional Bitcoin acquisition options within 180 days. Any proposed mechanism must be budget neutral and must not rely on new borrowing, taxation or deficit spending. Research could cover topics such as asset forfeiture, transactions involving non-Bitcoin government assets, and cooperative arrangements with states or private entities.

During the review, Senator Bill Foster expressed opposition to the reserve proposal, questioning whether Bitcoin was suitable as a government reserve asset due to its price volatility. Commission supporters argue that centralized Treasury custody and long-term holding would provide the government with a more stable framework for managing assets already acquired through confiscation procedures.

Reserve bill moves forward smoothly after a setback in CLARITY bill

The committee vote came after the Senate voted 49 - 50 procedural vote to reject the CLARITY Act, which prevented legislation covering the broader structure of the U.S. crypto market from reaching the 60 votes needed to advance.

The two bills deal with different aspects of federal encryption policy: the CLARITY Act focuses on regulatory jurisdiction and rules for digital asset markets, while H.R. Bill 8957 regulates federal ownership and management of Bitcoin and other confiscated digital assets.

H.R. Bill 8957 is now before the full House. A full house vote has not yet been scheduled, and the measure still needs to be passed by the House of Representatives, approved by the Senate and signed by the President before it can become law.
