The District of Colombia Circuit Court of Appeals found that Washington, D.C., was the appropriate jurisdiction to hear the four charges against Strinoff. "Jurisdiction" refers to the place where a case can legally be tried.

For money laundering charges, the court relied on evidence that an undercover agent conducted bitcoin-fog transactions from his Washington, D.C. office.

Regarding the accusation of unlicensed money transmission, the court held that there was sufficient evidence that the Bitcoin Mist had served customers in the jurisdiction.

Prosecutors said the ruling "directly supports" their position in Storm's case. They argued that Tornado Cash activities in the Manhattan area were sufficient to establish Storm's jurisdiction in New York for alleged money laundering and conspiracy to transfer unlicensed money.

Prosecutors referred to the testimony of Shakeeb Ahmed. Ahmed said he used Tornado Cash from his Manhattan apartment.

Dispute over jurisdiction in New York

In a motion for acquittal filed in 2025, Storm argued that Ahmed's use of Tornado Cash was not sufficient to establish jurisdiction. He believes the deals did not lead to alleged collusion.

The prosecutor disagreed with this. They argue that even temporary deposits help mixers because they increase the trading pool used to hide capital flows. Prosecutors pointed out that the same reasoning applied to Ahmed's activities and believed it proved that he used the service to facilitate the alleged conspiracy.

In August 2025, a jury found Storm guilty of colluding to operate an unlicensed money transmission business. But the jury failed to reach a consensus on money laundering and sanctioning conspiracy charges.

Storm filed a post-trial motion for acquittal in September 2025, claiming that prosecutors had failed to prove that he intended to help criminals abuse Tornado Cash.

Judge Fayla heard arguments on the motion in April 2026, but has not yet issued a ruling. If the above outstanding charges remain, a retrial on the charges of deadlock is scheduled to be held on April 26, 2027.

Storm's response

Storm criticized the new legal documents in a Platform X post posted on Monday: "The Justice Department is still doing everything it can to pursue me." He wrote.

He also pointed to the Ministry of Finance's announcement on Monday that it would withdraw its proposed cryptocurrency mixer rules. Storm argued that the government has taken contradictory attitudes towards cryptographic privacy tools.
