The debate on the structure of the U.S. crypto market has entered a critical week. Senator Cynthia Lummis is stepping up pressure on Democrats as the Senate holds a procedural vote on the CLARITY Act on September 15.
Loomis said on Platform X (formerly Twitter) that if the legislation fails to pass, Democrats should bear the consequences because they contributed to most of the current proposal. Her argument is straightforward: After months of negotiations and more than 100 changes proposed by Democrats, withdrawing at this time would cost the United States the loss of the federal crypto regulatory framework that lawmakers have been trying to build for months.
The latest draft covers a number of key adjustments
The latest version of the bill was released on September 10, including changes to decentralized finance (DeFi) regulation, Commodity Futures Trading Commission (CFTC) registration requirements and the way spot digital asset transactions are processed. Loomis's office said the text reflected the results of bipartisan negotiations held during the August recess.
Loomis says Democrats will be responsible for the consequences of failure.
Loomis's latest statement goes beyond simply calling for support for legislation. She believes that if the legislation fails, it will not only waste more than 100 changes Democrats helped secure, but it will also deprive consumers of the federal protections the bill is designed to provide.
Areas she singled out included disclosure requirements, protections against fraud, and regulations requiring the removal of problematic assets from platforms.
This is not a new argument by Loomis. She has previously said that Democrats received more than 100 concessions in the negotiations, including 33 changes to Title 1, three new chapters, 23 provisions dealing with illegal financial activities, and more than 30 changes related to the CFTC.

The latest draft also includes provisions on when non-truly decentralized encryption protocols need to be registered with the CFTC and comply with the requirements of the Bank Secrecy Act. Other amendments narrow the scope of application of certain DeFi provisions to only spot and cash digital commodity transactions.
However, Loomis's statement represents the Republican Party's position in promoting the bill rather than an objective description of the controversy. Democratic critics still disagree with parts of the code of ethics, anti-money laundering protections and other regulatory frameworks. Banking groups have also raised separate concerns, including the potential impact that crypto products and stablecoins may have on traditional bank deposits.
Therefore, the disagreement is not just about whether there should be rules for crypto assets. Much controversy centers on what should be included in the rules and what protections should be retained in final legislation.
Who will benefit if the CLARITY Act fails?
This debate raises another question within the crypto community. "X Finance Bull" asked who would benefit from maintaining uncertainty in U.S. crypto regulation if the CLARITY Act failed?
Vincent Van Code, a software engineer and member of the XRP community, gave an answer: existing large crypto exchanges.

His argument is that regulatory uncertainty constitutes a barrier that makes it more difficult for banks and other traditional financial institutions to enter the digital asset market. If comprehensive legislation provides these institutions with clear rules for providing crypto products and services, they will become strong competitors to existing exchanges.
According to this theory, maintaining the status quo may indirectly protect companies such as Coinbase from more competition.
There is certain economic logic behind this view. Regulatory uncertainty can increase legal, compliance and operating costs for financial institutions considering new crypto businesses. A clearer legal framework may allow more traditional financial companies to participate.
However, it is too absolute to claim that the failure of the CLARITY Act "only benefits" exchanges such as Coinbase. Coinbase itself has advocated clearer American-style crypto regulation for years and supported Congress's efforts to establish a digital asset market structure. Existing exchanges also face huge costs due to regulatory uncertainty, including litigation risks and complex compliance requirements.
At the same time, not all traditional banks are enthusiastic about current legislation. Banking groups have actively lobbied senators against terms they believe could threaten deposits or change competition between banks and crypto companies.
Therefore, the competitive landscape is more complex than a simple "bank versus exchange."
