The European Securities and Markets Authority initiates a collection of evidence on the safety of central counterparties 'use of tokenized collateral
The European Securities and Markets Authority (ESMA) has launched an evidence collection exercise to assess whether central counterparties (CCP) within the EU can safely use tokenized collateral. The move, announced on October 9, 2026, focuses on a core test of the clearing house: whether collateral can remain available despite market stress or a default by a clearing member.
According to the regulator's announcement, ESMA is asking whether central counterparties can access, transfer and convert tokenized assets into liquidity when faced with the above-mentioned pressure situations. This question goes beyond the scope of "whether assets can be represented on a distributed ledger". More importantly, it is to examine whether this form of representation can continue to perform the required functions in the default management process.
Testing tokenized collateral with clearing member default scenarios
The central counterparty (CCP) is located between the parties to cleared transactions and is responsible for managing collateral designed to protect the clearing system from member exposure. When a stressful event occurs, the actual ability to actually control collateral and convert it into available funds is often as important as its value before the event occurred.
The review treated the settlement of obligations surrounding tokenized assets as part of the collateral workflow rather than treating it as a separate issue from the transfer of securities or other pledged assets. This includes tokenized cash: ESMA's framework evaluates tokenized assets together with their settlement chain, rather than considering either party in isolation.
Legal enforcement and settlement finality are the core of the assessment
According to TradeInformer's report on the initiative, the areas under review include legal enforcement, liquidity, isolation, settlement finality and operational resilience. These conditions determine whether central counterparties can rely on collateral when normal market functions are disrupted.
- Legal enforcement: Focus on whether collateral rights can be maintained.
- Segregation: involves the separation of assets and claims.
- Settlement Finality: Resolves the issue of when transfers are considered completed.
- Operational resilience: covers the ability of relevant systems and processes to continue to operate during interruptions.
- Liquidity: Under the stress scenarios clearly highlighted by ESMA, it refers to whether collateral can be converted into funds when needed.
TradeInformer reported that the review focused on these safeguards rather than immediately expanding the categories of eligible collateral that can be used by central counterparties. This boundary is important for market participants who view the consultation as a gathering of regulatory evidence rather than a change in established rules.
ESMA's approach also retains the possibility that different tokenization structures may produce different risk outcomes. The consultation covers traditional assets represented in tokenization, native ledger issuance, and hybrid arrangements, each of which may involve unique custody, transfer and settlement paths.
Response deadline is January 15, 2027, after which ESMA will weigh regulatory actions.
According to the consultation notice, stakeholders have until January 15, 2027 to submit feedback. ESMA said it will evaluate feedback in the first quarter of 2027 before deciding whether regulatory or supervisory action is needed.
This timetable provides authorities with a clear evidence gathering stage before making subsequent decisions. For clearing members, central counterparties and companies developing tokenized settlement arrangements, the submissions will help establish how ESMA views the legal, liquidity and operational requirements that must be met during a market crisis.
