The latest spending announcement follows the Senate's rejection of the Digital Asset Markets Clarity Act. The bill aims to establish federal-level rules for the regulation of the cryptocurrency market and divides regulatory powers into the joint responsibility of the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC).

The Senate rejected the motion to close debate by a vote of 49 to 50. According to the rules, 60 votes are needed to advance the bill. All Democratic senators present voted against it, as did Republican Senators Susan Collins, Josh Hawley and Jerry Moran. Republican Senator Tom Tillis changed his vote to "no" for procedural reasons in order to reintroduce the bill later.

This vote leaves little chance of reviving legislation before the mid-term elections on November 3. Stand With Crypto, an advocacy group backed by Coinbase, also warned of the consequences of the election after the vote. The group said it would include senators 'voting records in its politician scorecard while mobilizing supporters to prepare for the election.

Fairshake's financial strength and campaign strategy

Fairshake is mainly funded by Coinbase, Ripple and Andreesen Horowitz. As of January 2025, the organization had raised $116 million for the 2026 election and reported remaining funding of $108 million at the end of August.

Fairshake claims to support candidates in both parties who support friendly cryptocurrency policies. However, its ads often avoid discussing cryptocurrency issues directly, focusing instead on other issues that are more likely to affect voters.

The group adopted this strategy during the 2024 election and again in this year's congressional primaries.
