The Securities and Futures Commission of Thailand approved Bitcoin and Ethereum ETFs, and the new regulations will take effect on October 16.

The Securities and Exchange Commission of Thailand (SEC) has officially approved domestic Bitcoin and Ethereum exchange-traded funds (ETFs) under the framework of the new regulations. These new regulations cover fund management, investment qualifications and nationwide operating requirements. According to the announcement of the Securities and Futures Commission of Thailand, a total of 11 regulatory notices will officially take effect on October 16, aiming to establish a rule system for cryptocurrency investment products.

Strict custody and investor protection mechanisms

This regulatory framework covers fund management, digital asset custody, trading restrictions and supervision of cryptocurrency ETFs listed on the Stock Exchange of Thailand. Regulators conducted public consultations between April and September 2026, and a majority of respondents supported the proposed measures.

To ensure investor safety, new cryptocurrency ETFs must follow strict custody rules and only trade on the Stock Exchange of Thailand. In addition, the regulations clearly prohibit margin loans for the purchase of cryptocurrency ETFs, a restriction that is consistent with existing regulations on digital asset trading and aims to prevent the risk of over-leveraging.

Investors must fully understand the risks before trading, and securities companies must provide clear information about cryptocurrency investment products. Brokers should also encourage client-appropriate asset allocation and dissuade investors from excessive exposure to the cryptocurrency market based on their personal risk tolerance.

Investment Strategy and Asset Management Requirements

In the initial phase, only Bitcoin and Ethereum meet qualifying asset standards, and other cryptocurrencies must meet regulatory standards covering liquidity and security. Before establishing such funds, asset management companies must demonstrate that they have adequate staffing, operating systems and arrangements with qualified service providers.

In addition, cryptocurrency ETFs must adopt a passive investment strategy and maintain at least 80% of their average positions concentrated in a single cryptocurrency each year.

Expansion of access to domestic funds and restrictions on foreign products

At the same time, the Securities and Futures Commission of Thailand has expanded the investment qualifications of mutual funds and private equity funds to allow them to invest in domestic cryptocurrency ETFs. Previously, these investment vehicles were only allowed to invest in foreign cryptocurrency ETFs and lacked the same authorization for locally established products.

It is worth noting that regulators will impose restrictions on certain foreign cryptocurrency investment products, including depositary receipts linked to overseas cryptocurrency investment funds. For clients of non-designated wealthy and institutional investors, securities companies also face restrictions when assisting them in investing in foreign cryptocurrency ETFs.

Custody and Supervision Compliance

Licensed digital asset custodians must properly custody cryptocurrency assets, while asset management companies can only outsource investment management to licensed operators. Qualified digital asset companies can register as mutual fund supervisors if they meet financial, personnel and operational requirements. These supervisors can only supervise cryptocurrency ETFs and must maintain regulatory compliance throughout their operations.

Overall, Thailand's regulations establish a domestic cryptocurrency ETF framework while strengthening custody supervision, investment management standards and investor safeguards.
