News and research platform Bull Theory (@BullTheoryio) sounded an alarm, noting that the Republican leadership has withdrawn its agenda for the two weeks of September 21 and September 28 from the legislative calendar. Lawmakers will leave Washington by September 17 and will not return until mid-November.
This decision poses a critical timing challenge for the Digital Asset Market Clarity Act (CLARITY Act). The bill's first procedural vote in the Senate is scheduled for September 15. This means that both houses have only two days of overlap before the House adjourns.

The CLARITY bill was passed by the House of Representatives in July 2025 and passed the Senate Banking Committee for review in May of the same year. All 53 Senate Republicans have pledged to vote yes, so seven more votes need to be won from Democrats.
House whip expresses dissatisfaction
House Republican majority whip Tom Emmer publicly expressed dissatisfaction. He said the House passed the CLARITY bill with nearly 100 Democratic votes more than a year ago, and the bill subsequently ran aground in the Senate. His message was clear: the House has acted, but the Senate has failed.

But because lawmakers will not be in Washington, they will not be able to perform that responsibility. Emmer's criticism of the Senate's inaction is now in sharp contrast to his chamber's absence.

Cryptocurrency traders and political observers have expressed concern. One analyst pointed out that the September 15 vote was only the first procedural hurdle, and there was little room for the remaining work in the two overlapping days before the House left. Another analyst believes that the short window period amounts to a death sentence for the bill's 2026 prospects.
Comments suggest that if the bill gains enough momentum, the president can recall the House. Others expressed frustration at the speed of legislative action, with some pointing out that before another long holiday midterm election, the House worked only four days before leaving.
What happens next?
Senator Cynthia Lummis has closed the door to further negotiations. She made clear that the Senate should vote and put the results into effect. Loomis also warned that if the bill is not passed before the midterm elections, meaningful crypto legislation could be delayed until 2030 or later.
The September 15 cloture vote is the immediate test. If it gets 60 votes, the Senate debate will begin. Whether this process ends before September 17 will determine the fate of the CLARITY Act in 2026.
