Selig noted on Wednesday that the Senate vote was regrettable, but the CFTC was ready to issue rules for this "new frontier." He emphasized that Americans should now enjoy regulatory clarity, legal certainty, and consumer protection in the industry-wide crypto market.
Selig said that President Trump has promised to establish a future-oriented and forward-looking market structure for regulating cryptoassets. To this end, the CFTC will use its existing legal powers to achieve this goal. The statement came hours after the CLARITY Act was blocked in the Senate. The bill originally required 60 votes to advance, but in the end only 49 votes against it (Note: The original logic here may be ambiguous, usually means that the 60-vote threshold has not been reached or a specific procedural vote has failed. The core fact is that the bill has not been passed).
At the same time, Securities and Exchange Commission Chairman Paul Atkins also said that the SEC will take action within its legal authority, with or without legislative support. He said the agency is committed to providing certainty to entrepreneurs and investors.
Market expectations and industry reactions
The CFTC's existing regulatory framework relies mainly on its anti-fraud and anti-manipulation powers over digital goods markets, which the committee has previously used in multiple crypto enforcement actions. Although Selig did not provide a specific timetable for the new framework, the proposed rules typically need to be discussed at CFTC meetings, published in the Federal Register, and accepted public comment before being finalized.
