Qualcomm and ARM lawsuit puts billions of dollars in chip licensing fees at risk

Qualcomm returns to Delaware court: A game that could determine billions of dollars in royalties payments

Arm again appeared in a Delaware court on Monday. The outcome of the lawsuit will determine whether one of Arm's largest customers can stop paying huge royalties for up to five years.

Qualcomm accused Arm of violating contract, withholding necessary chip testing tools and leaking a threat to terminate a key license in 2024. Qualcomm said the behavior damaged its prospects of negotiating potential chip deals with Meta Platforms. Arm denies default and argues Qualcomm failed to prove the actual loss.

This dispute comes at a sensitive moment in the AI chip industry. Currently, Arm, AMD, Broadcom and Qualcomm are all accelerating their forays into data centers, personal computers and custom chips.

Qualcomm seeks fee waivers for up to five years

The biggest financial focus of the case is on Qualcomm's proposed remedies. Qualcomm wants the right to suspend royalty payments to Arm for up to five years. Given the centrality of Arm's licensing model in Qualcomm's processor business, this potentially involves billions of dollars.

The court is considering whether this remedy should be retained, making the case far more important than ordinary contract disputes. As Qualcomm's business expands from smartphones into personal computers and data center computing, and as the broader AI infrastructure boom creates new opportunities for processor and network companies, the risk exposure in cases is expanding.
