Note to XRP holders: CLARITY Act faces major time challenges

CLARITY bill overcomes major procedural obstacles in the Senate, changes in the House schedule bring new variables

The CLARITY bill (Cryptocurrency Market Clarity Act) has overcome major procedural obstacles in the Senate. However, a new variable is affecting the situation: House Republican leadership canceled the planned final two weeks of September. This move shortens the legislative window, which cryptocurrency analyst Diana (@InvestWithD) pointed out could lead to further delays in final adoption.

Diana posted relevant updates on social media, pointing to conflicts between the Senate's expected timetable and the House's shortened new agenda. The Senate aims to take preliminary action on the CLARITY Act on September 15. As Diana outlines, the problem is that the Senate's own process "may take approximately 1.5 to 2 weeks" due to procedural votes and potential amendments.

Updated: The CLARITY bill faces a major time problem-the House is scheduled to leave Washington on September 17 and may not return until mid-November, when the House Republican leadership has canceled the planned final two weeks of September, Significantly shortened the remaining legislative window

The heart of the scheduling conflict

House members are currently expected to leave Washington, D.C. on or before September 17. The next time they are scheduled to return is mid-November. There is only a two-day gap between the Senate's start of action on September 15 and the House's departure on September 17, which is the key to the time worry.

The Senate cloture vote on September 15 is the starting point. After crossing the 60-vote threshold, the Senate will enter the debate period, amendment stage, and then hold a final vote. This sequence of processes alone takes time. If the version of the bill produced by the Senate differs from the text previously passed by the House, the House must agree to the final version before the bill is submitted to the president for signature.

What happens next?

Regardless of the House's agenda, the Senate can still move forward as planned. Diana acknowledged that the legislation "may eventually come back to the House again later." The more critical variable is timing. If the House does not resume work until after the election in mid-November, any remaining House action will be in a different political environment, because voters have already decided on control of Congress.

Senator Tim Scott has publicly said the bill will become law, pointing to September as the best window for progress. The CLARITY Act was passed by the House in 2025 and was advanced by the Senate Banking Committee in May. Senate Majority Leader John Thune submitted a motion for closed-debate before the Senate adjourned, ensuring that the bill had time to be discussed in plenary session when the Senate resumed.

What does this mean for XRP?

The CLARITY Act will establish a regulatory framework for digital assets, clarifying which assets fall under the jurisdiction of the U.S. Securities and Exchange Commission (SEC) and which fall under the jurisdiction of the Commodity Futures Trading Commission (CFTC). XRP holders have been closely monitoring the progress of the bill because it will directly affect Ripple and XRP's regulatory environment.

Regulatory clarity will come sooner if it is finally passed before the election. Delaying until after the election would prolong the current uncertainty. This is the biggest risk Diana pointed out. Senator Cynthia Lummis has said missing the window could delay regulatory clarity until 2030.
