Novogratz: Weekend negotiations preserved the prospects of the Clarity Act, but government ethics provisions still blocked bipartisan consensus.

Galaxy Digital CEO Mike Novogratz dismissed suggestions that the Clarity Act lost its chance to pass Congress. He noted that the weekend's negotiations had instead strengthened his belief that the legislation could be introduced to the full Senate.

However, government ethics provisions remain one of the biggest obstacles faced by lawmakers when negotiating a cryptocurrency market structure bill. Novogratz believes the bill's prospects will largely depend on whether the White House accepts proposed language designed to address these ethical concerns. His assessment brought renewed confidence to supporters after months of political differences over federal cryptocurrency regulation left the situation unclear.

Patrick Witt, executive director of the President's Digital Assets Advisory Council, also expressed optimism about the possibility of the bill passing. He dismissed negative expectations surrounding the bill and noted that lawmakers were preparing for a key procedural vote on Tuesday. The Senate vote, scheduled for September 15, will determine whether negotiations can move to a broader review stage. Although the vote itself will not lead to final legislative approval of the bill, if passed, it will open the way for Senate debate and further revision.

Lawmakers also face a limited legislative window, and opportunities for completing major regulatory measures will gradually diminish as the midterm election campaign unfolds.

Government ethics provisions may become key to bill advancement

The Senate Banking Committee approved an early version of the bill with a bipartisan vote of 15 - 9 in May. In July, lawmakers released updated draft legislation that merged proposals from the Senate Banking and Agriculture Committees. A separate version of the revision emerged Thursday allowing senators to review major changes ahead of Tuesday's procedural vote. The approximately 630-page proposal covers decentralized finance (DeFi), regulatory authority, consumer disclosure, cryptocurrency trading, and federal market regulation.

She warned that if the bill is rejected, cryptocurrency users will not be able to obtain comprehensive protection and standardized disclosure requirements. Loomis pointed out that the next realistic opportunity to establish rules for the structure of the cryptocurrency market may not appear until 2030. Backers must resolve remaining ethical disputes while maintaining enough bipartisan support to move the proposal through the Senate.
