Before the MiCA transition period ended on July 1, Binance told Cointelegraph that access rights in the EU area would depend on the user's jurisdiction, account status and "service provider." According to FT, some EU traders are currently trading through Binance's regulated entities in Abu Dhabi. When asked whether it was negotiating with EU regulators, Binance did not confirm, saying only that it "complied with applicable regulatory requirements."

ESMA calls for stronger enforcement powers over non-EU companies

On Wednesday, ESMA called for stronger powers over non-EU companies that solicit business from European investors without authorization. ESMA said its proposal would support faster and more consistent supervisory action across the EU and reduce opportunities for companies to take advantage of regulatory differences.

The move follows a statement by ESMA Chairman Verena Ross on Monday, noting that the regulator's MiCA focus has shifted from "rule-making to oversight and coordination."

Binance does not appear on ESMA's non-compliant list

According to ESMA's updated data on September 30, the number of entries in the register of non-compliant encryption service providers increased from 164 on July 16 to 173. However, Binance does not appear on the latest list. MiCA describes the list as "non-exhaustive" and ESMA updates it based on information from national authorities and other sources.

The German Federal Financial Supervisory Authority (BaFin) declined to provide further information, citing legal confidentiality obligations. As of press time, ESMA and regulators in France and Greece had not yet responded.
