The U.S. Treasury Department's Financial Crimes Enforcement Network (FinCEN) has withdrawn two proposed regulatory rules for the cryptocurrency industry, involving "hybrid currency services" and "unmanaged wallets." Among them, the rules on non-custodial wallets were first proposed in December 2020, while the rules on mixed-currency services were proposed in October 2023. FinCEN said the withdrawal was part of the Trump administration's deregulatory agenda and noted that the mixed-currency rules could have a "chilling effect" on legitimate activity. The Crypto Innovation Council welcomed the decision, saying it has "positive implications for the digital asset ecosystem."
Main contents of the withdrawn rules
The first proposal dates back to December 2020 and aims to impose record-keeping, verification and reporting requirements on specific cryptocurrency transactions involving "non-managed wallets." The so-called unmanaged wallet refers to a cryptographic wallet that is directly controlled by the user and whose funds are not held by a bank or exchange.
The second proposal, first proposed in October 2023, plans to take special measures against what FinCEN calls a "convertible virtual currency mix." Crypto-hybrid services make it more difficult to track the source of funds by mixing funds from multiple users.
In its announcement, FinCEN pointed out that mixed currency rules may have a "chilling effect" on legal activities and place a heavy reporting burden on relevant financial institutions. After reviewing public opinion on the two proposals, FinCEN decided to withdraw them.
