Thailand's Bitcoin ETF rules establish passive exposure and custody standards
Core points: Thailand will launch spot bitcoin and Ethereum exchange-traded funds (ETFs) based on domestic frameworks on October 16. Investors can obtain investment channels for relevant assets through the Securities Exchange of Thailand (SET). The new regulations require a passive management strategy, with a net exposure to a single digital asset of no less than 80%, and asset custody must be carried out through a custodian regulated by the Securities and Exchange Commission (SEC).
Investment Restrictions and Market Access
Thai securities companies are not allowed to provide margin loans for the purchase of such ETFs. At the same time, retail customers cannot directly invest in overseas digital asset ETFs through local brokerages. Although mutual funds and private equity funds can invest in digital asset ETFs established in Thailand, existing investment limits and initial asset lists remain unchanged.
This regulatory framework aims to provide a compliance path for digital asset investment while strictly controlling custody risks, leverage use and retail access for overseas products. Although investors can gain exposure through brokerage accounts, this does not mean that the market volatility and other associated risks inherent in Bitcoin and Ethereum are eliminated.
Strict custody and disclosure requirements
In the initial phase, the Securities and Exchange Commission restricted access to overseas products. Thai securities companies are not allowed to act as agents for retail customers to buy and sell overseas digital asset ETFs. Direct investment in overseas funds remains limited to institutional investors and high net worth individuals. In addition, at this stage, depositary receipts linked to overseas digital asset ETFs will not be issued or sold.
Regional comparisons and future outlook
Bitkub Group co-founder Attakrit Chimphlapibul said the policy follows the path of the launch of U.S. spot ETFs, creating compliance channels for institutional and retail participants in the market. The Securities and Exchange Commission of Thailand noted that during a public consultation earlier this year, market participants generally supported regulated access methods. Regulators have emphasized that infrastructure, investor protection and education should be completed before wider public access.
Therefore, Thailand's Bitcoin ETF framework adopts an "approved but limited open" strategy: allowing domestic listings but excluding leverage, overseas retail brokerage services and other alternative products. This approach allows the Securities and Exchange Commission to assess custody, trading and investor understanding before expanding eligible assets or relaxing distribution rules.
The move also makes Thailand a member of the Asian market in building a channel for regulated digital assets. Hong Kong and the United States already have spot Bitcoin and Ethereum products. Thailand's framework is characterized by its initial limits on overseas exposure and strict requirements for passive funds. Further changes in the future will depend on market conditions and the maturity of infrastructure. Initially, the listing of Thailand's Bitcoin ETF will remain domestic, and broader access will depend on regulatory review and infrastructure readiness.
