FollowingNew York prosecutors accuse Polymarket of suspected gambling without a license and seek an injunction to prevent its forecast market operations.
New York state prosecutors have accused Polymarket of engaging in unauthorized gambling activities and requested a court order to ban the company's forecast market operations throughout New York state. Prosecutors demanded recovery of losses and financial penalties, while pointing out that the company failed to pay gambling taxes and allowed users below the legal betting age in New York State to participate.
Polymarket plans to remain in New York State as lawsuits against competitors Kalshi, Coinbase and Gemini unfold. New York Attorney General Letitia James and Gov. Kathy Hochul have taken Polymarket to court, accusing it of predicting market operations constituting unauthorized gambling and putting young New Yorkers at risk.
The indictment requests a judge to issue an order to stop Polymarket from operating unauthorized gambling operations in New York State. Prosecutors also demanded fines, illegal gains without receipts, and compensation to aggrieved customers.
Lack of licenses and tax disputes
According to the Attorney General's Office, Polymarket allows users to invest money in sporting events and other uncertain outcomes. New York State believes that because customers have no control over the outcome, these contracts meet the definition of gambling.

这些措施目前仅为向法院提出的请求，最终需由法官裁定Polymarket的合约是否违反州法律。此次起诉标志着纽约州打击预测市场平台行动的又一进展。
今年7月，詹姆斯和霍赫尔宣布对Kalshi提起诉讼，指控其涉嫌无证赌博。同年4月，纽约州还因预测市场业务对Coinbase和Gemini提起了诉讼。
这些案件处于更广泛的监管争议之中，即当局应如何监管与未来事件挂钩的合约。各州已将这些产品纳入赌博法监管范围，而预测市场公司则主张应由联邦机构进行监管。
Polymarket承诺留守纽约
Polymarket首席法务官尼尔·库马尔（Neal Kumar）回应称，公司打算继续留在纽约州。他表示，Polymarket已与州政府官员合作，以解决他们的关切。
库马尔还提到，公司起源于纽约的一间公寓，并在当地拥有超过350名员工。然而，他的回应并未解决州方的核心主张，即Polymarket需要获得博彩牌照才能提供其合约服务。
法院对纽约州请求的裁决，可能决定Polymarket能否在纽约州继续提供当前的市场服务。目前，这起诉讼仍属指控阶段，但公司已明确表示有意留驻纽约。
