Conviction in the $53.3 million DeFi vulnerability case: German investors should know

Manhattan Federal Court jury ruled that DeFi exploit constitutes computer fraud and money laundering.

On October 7, 2026, a jury in Manhattan Federal Court found a 36-year-old security consultant from Maryland guilty of computer fraud and money laundering. Prosecutors allege that the defendant stole approximately $53.3 million from decentralized exchange Uranium Finance through two attacks in 2021.

The defendant's defense lawyer argued that he had only called publicly available functions in the smart contract, forged any credentials, and did not deploy malicious code. However, the jury dismissed the defense after less than two hours of deliberation.

"Code is law" is no longer a gold medal for exemption

For German holders, this is not just news about their investment portfolio, but also a redefinition of the basis for DeFi (decentralized finance) operations. Depositing tokens into a liquidity pool means leaving the space where rules are set by regulators and entering the realm where payouts are determined solely by program code. Until Wednesday, whether exploiting code loopholes was a crime or just a clever operation within the rules had been an open question. Now, the U.S. court has given the answer in accordance with U.S. law, and the impact of this answer far exceeds the case itself.

A liquidity pool is a smart contract into which users deposit two tokens for redemption by others; in return, depositors receive a portion of the transaction fees. Uranium Finance runs such liquidity pools on the BNB Chain (the network behind BNB), whose code is derived from well-known templates.

Arithmetic flaw in paired contracts: An attack affected 26 liquidity pools

Pair contracts are responsible for holding reserves for a specific token pair and recalculating the amount available for each exchange. According to analysis in 2021, Uranium Finance's recalculation mechanism has an error of 100 times: the contract believes that its position is 100 times its actual position. Anyone who knows about this vulnerability can invest a very small amount of money and withdraw a very large amount of money.

This flaw was introduced during the migration to a new contract version. The project team had previously asked users to transfer their deposits to a new version, and the attack occurred during the migration process. The first strike occurred on April 8, 2021, and approximately $1.4 million was stolen through a series of calls to the reward function. The second attack occurred on April 28, 2021, and simultaneously targeted 26 liquidity pools, forcing the agreement to close.

The amounts in different reports vary and should not be blurred. Prosecutors cited the second attack as approximately $53.3 million. Industry publications added up the two attacks and came up with a figure of $54.7 million to just under $55 million. A 2021 incident database put the damage at $57.2 million. Therefore, the range of $53.3 million to $57.2 million is a more honest figure.

What preceded the attack was remarkable: The team said they suspected a key flaw might exist, but failed to detect it. Multiple code reviews did not flag it as a critical issue.

Far-reaching impact of the decision: Technical feasibility does not equal permissibility

The concept of "code is the law" holds that in open agreements, only behaviors allowed by program code apply, and no other rules can be broken. According to this interpretation, the attacker only did what the contract allowed, and the loss should be attributed to the depositor's design error.

In court, this became the argument that "there was no deception and no intrusion, because every function used was public and could be called by anyone." The jurors did not adopt this view. After more than two hours of deliberation, guilty verdicts were reached on both charges, showing that they believed there was little controversy. The trial report clearly stated that this was a rejection of the defense line.

The significance of the verdict goes beyond the scope of this case. It distinguishes between two things that are often confused in DeFi debates: whether a transaction is technically feasible and whether it is morally or legally permissible. In the past, the two were often equated, citing a lack of operator agreements and a lack of family rules. But now the jury has rejected that argument.

Specific charges: Computer fraud and money laundering

The defendant was found guilty of two counts in the indictment. The first is computer fraud, which involves two attacks themselves. The second item is money laundering, which involves the subsequent disposal of funds.

Prosecutors pointed out that the maximum legal penalty for computer fraud is ten years and money laundering is twenty years. The office itself emphasized that these caps are set by the legislature, and the actual sentences are decided by the courts alone. The sentence covers a conviction, not a punishment.

Why is money laundering more serious?

The maximum sentence for cover-up is higher than the act itself, which may seem unreasonable at first glance, but the reason is true: Computer fraud describes a single visit, while money laundering is a series of acts that span several years. Sending stolen tokens through a mixer and then converting them into physical assets means building the chain step by step.

Fund flows: Tornado Cash, Trading Cards and Roman Silver Coins

Uranium Finance ceased operations after the second attack. An abandoned agreement has no legal department, no customer service, and no balance sheet to pay compensation. Anyone who made a deposit there endured a five-year wait alone and today received a guilty verdict but no payment.

The scale of the problem is growing. Our quarterly data analysis shows that in just three months, losses caused by cryptocurrency hacking reached US$1.26 billion, the highest level in 2026. The verdict five years after the incident changed little about this calculation.

MiCA does not cover decentralized agreements: differences from licensed exchanges

MiCA is an EU regulation that requires cryptocurrency service providers to be licensed and regulated. It targets companies with counterparties, not codes. Legal reviews describe exemptions for true DeFi protocols more narrowly: exemptions apply only if the provider is technically and governance decentralized, operates entirely through smart contracts, and has no legal entity as a counterparty. If the founder retains the right to intervene or charges a fee, operator status that requires licensing may still arise in some cases.

In practice: On a licensed exchange, you have a contract partner with a registration location, regulatory authority, complaint channels and obligations to isolate client funds. In the liquidity pool, you only have one contract. Anyone who wants to hold both side by side will find a licensed institution in our comparison of regulated cryptocurrency exchanges; there is no restriction on the other side of the pool because it belongs to no one.

The boundaries of responsibility of German regulators

Germany's BaFin publicly warns against unlicensed publications in the form of DeFi pledges. In contrast, code flaws in truly decentralized protocols are not areas that any authority can fix. No one can suspend a transaction, freeze an account, or reverse a payment.

Audit passed, flaws remain: What does smart contract audit cover?

Smart contract audits are paid reviews of contract codes by third parties to detect errors and attack routes before money flows in. Based on Uranium Finance's subsequent post-mortem analysis, multiple reviews did not flag decisive defects as critical issues.

But this does not mean that audits are worthless, it just needs to be viewed correctly. Audits are for specific versions of code on specific dates. Each subsequent migration was unaudited until reviewed again, and at Uranium Finance, defects entered the system through such migration. Therefore, the audited code is just a snapshot and does not guarantee that the version in which you will fund tomorrow will be safe.

How to identify reliable audits boils down to two questions: Is the review report publicly available in full and dated? Is it related to the contract address where your current funds are located? If any of these are missing, the audit does not cover your investment.

German Law and Exploitation: This case does not set a precedent

The conviction was made under U.S. law, and the U.S. jury's verdict is not binding on German courts. Based on the status of published legal reviews, the German Supreme Court has not yet ruled on whether exploiting smart contract loopholes constitutes a criminal offence.

The law firm's legal review framed this issue in Germany in a different way than the U.S. indictment. Accordingly, pure programming errors are not criminal acts in themselves; they become punishable only when deception is added or interference with other people's data, and the crime of data tampering under Section 303a of the Criminal Law will be invoked. In all variants, intent must be proved, which is considered difficult in automated contracts. This framework comes from advisers rather than courts and should be read accordingly.

As a result, victims of exploits in Germany face a disturbing discovery: criminal liability is uncertain, perpetrators are often unknown, and protocols may no longer exist. Calling the police is still worth it because it records behavior and may serve as the basis for later distribution of seized funds. There is little chance of quick compensation.

Loss for tax purposes remains an independent issue

The loss caused by the exploit is not sales, and whether it can be used for tax deductions depends on the case and documentation. Here, the record, timing and size of the deposit are more important than legal issues. Anyone who does not have a complete record of their own capital flows can find procedures that generate conclusive evidence in a comparison between cryptocurrency tax software and portfolio trackers.

Custody and counterparty risk: Where exactly is your currency in the DeFi pool?

Counterparty risk is the risk that the person holding your assets will not be able to return them. In a liquidity pool, you don't hold coins, but a claim on a contract, and the reliability of this claim depends entirely on the internal arithmetic logic. At Uranium Finance, arithmetic logic goes wrong a hundred times, so the claim becomes worthless before anyone responds.

This mechanism produces a clear division of positions independent of market opinion. Whether it is intended to be held for the long term, it should be placed in your own custody without third-party contracts or third-party balance sheets. The devices used to manage these devices and their prices are detailed in Hardware Wallet Comparison. Anything that is valid in the pool is a pledge that assumes the risk of total loss, no matter how high the promotional benefits seem.

The second consequence involves authorization. Once a contract is granted unlimited access to tokens, the door remains open even if you have already withdrawn your deposit. Periodic revocation of such authorizations takes only a few minutes and limits the damage caused by future contract failures.

February 16, 2027: The maximum sentence of twenty years remains undetermined

Sentencing is set for February 16, 2027. Prior to this, the offence had been established, but the length of the sentence had not yet been determined, and the ten and twenty years cited were legal ceilings rather than predictions. Trial reports put the case in a series of lawsuits in the United States, in which courts have increasingly tended to treat cryptocurrency theft as a traditional property crime.

For the European market, the next important date is different. As long as EU rules exclude decentralization agreements, the responsibility for reviewing liquidity pools shifts entirely to depositors. The Manhattan verdict did not change anything about this, and that was the actual news on Wednesday.

DeFi exploit verdict: $53.3 million, but no pause button

The guilty verdict answers five years of unresolved questions and is against the attacker. As far as depositors 'positions are concerned, little has changed: pools without operators are held accountable when things go wrong, and the money disappears before the courts even gain jurisdiction.

  • Separate owned positions from pledges: The assets you intend to hold should be placed in your own custody, not in contracts you have not read. Relevant equipment and prices are listed in detail in the Hardware Wallet Comparison.
  • Clarify who your counterparty is: Where there are licensed counterparties, there are regulatory and complaint channels; in the liquidity pool, there are neither. Licensed institutions are listed in the comparison of regulated cryptocurrency exchanges.
  • Record every deposit immediately: Without evidence of the duration and size of the deposit, neither the allocation of seized funds can be carried out nor the loss can be taxed. A comparison of cryptocurrency tax software lists suitable procedures.
