Senator Loomis explains the importance of the CLARITY Act to cryptocurrency and XRP holders

When a cryptocurrency exchange fails, it is often ordinary customers that suffer. They are forced to rank behind lawyers and creditors, often recovering only a small portion of their assets. As one of the strongest advocates of the CLARITY Act, an act to explicitly create legal rules to strengthen the regulation of digital assets, Senator Cynthia Loomis said her bill aims to address this dilemma.

Loomis believes that this issue is not a hypothetical risk. "Today, when cryptocurrency exchanges go bankrupt, customers are forced to queue up with lower-priority lawyers and creditors in the hope of recovering some of their assets." "The CLARITY Act ensures that consumer assets are protected and has the same status as in traditional financial systems," Loomis wrote.

Warning of FTX incidents

In November 2022, FTX crashed, causing customers to lose billions of dollars. The bankruptcy court treated client funds as part of the bankruptcy estate, forcing ordinary users to compete with institutional creditors for remaining assets. Similar consequences have occurred in cases such as Celsius, Voyager and BlockFi. Each collapse exposes the same legal loophole: cryptocurrency customers lack legal priority over their own assets.

The way traditional financial systems operate is completely different. Under existing securities laws, client funds held by licensed brokers must be segregated from company assets. If a broker fails, clients have the right to get their own funds back first. However, the cryptocurrency field previously lacked corresponding protection mechanisms, and the CLARITY Act was enacted to change this situation.

The legislation defines digital goods as "customer property" under U.S. bankruptcy law. This classification removes customer assets from the general insolvency estate of a failed exchange. In the order of settlement, the customer will have priority over the other party to receive compensation. [TAG

The relevant provisions of the

Act bring digital goods into the insolvency framework of regulated goods contracts. At the same time, the bill adds mandatory isolation requirements: Exchanges and brokers must deposit customer assets in qualified digital asset custodians and must be strictly separated from the company's own funds. This mixing operation has caused huge damage to FTX and will become prohibited after the bill is passed.

Loomis 'persistence and advancement

Loomis has been promoting the implementation of the CLARITY Act for many years. She serves on the Senate Banking Committee and plays a central role in the bill's progress in the Senate. She publicly defended the bill and refuted various criticisms. In addition, she also warned that if the bill is not passed within the current legislative window, the cryptocurrency regulatory process may be delayed until 2030. The Senate is scheduled to hold a closing debate vote on September 15.

Impact on cryptocurrency holders

XRP holders and the broader cryptocurrency community are closely monitoring the progress of the CLARITY Act. The bill represents the first federal-level framework that would give digital asset holders the same recourse as investors in stocks and commodities.

If the bill passes on a September 15 vote, it could encounter delays in the House, but Republicans are eager to send it to the president for signature. Once the bill takes effect, the rules for handling the next exchange collapse will be completely changed. Customers will no longer be at the end of the liquidation queue.
