New regulations for cross-border crypto transactions by Brazilian users: Use and counterparty information must be declared starting from November 1, 2026
Starting from November 1, 2026, Binance users in Brazil must clearly state the purpose of the transfer and confirm the details of the counterparty before processing any cross-border crypto transactions. This adjustment aims to bring Binance's operations into line with Central Bank of Brazil Resolution BCB No. 521/2025, incorporating international virtual asset transfers into the country's formal framework foreign exchange regulatory system.
Specific compliance requirements and implementation details
According to the new regulations, if a user sends cryptocurrency to an entity outside Brazil on the coin platform, or receives cryptocurrency from abroad, the following operations must be completed:
- Statement the purpose of the transfer: Users must clearly explain the specific reasons for the transfer of funds.
- Confirm counterparty identity: Users need to provide and verify counterparty details.
After completing the above steps, Binance will report relevant transaction data to the Central Bank of Brazil on a monthly basis. It is worth noting that this regulation only applies to cross-border transactions. Transfers between Brazilian residents are not affected, such as when transferring cryptocurrency to exchanges in Brazil or other local Brazilian user accounts, the process remains unchanged.
If the necessary information is not filled in as required, the withdrawal request will not be reviewed and there will be no circumvention mechanism. Deposits may be pending or refunded if counterparty information is missing.
Classification standards and limit descriptions
The system adopts different classification logics based on the transfer amount:
- US$50,000 and below: Users can choose one of the 10 preset "transfer purpose" categories.
- More than US$50,000: You need to choose from a complete list of 96 categories and no longer provide generic "other" options.
To assist users in making accurate choices, the interface provides a search function and help text. In addition, under current Central Bank of Brazil regulations, the transaction limit for transfers to counterparties not authorized in the Brazilian foreign exchange market is US$100,000 per transaction; this limit is expected to be raised to US$500,000 in the near future.
Two special circumstances handling mechanisms
- Transfer to personal accounts on overseas exchanges: Such operations are regarded as transfer of funds between different accounts of the same person. Users only need to select "Send to yourself", and the system will automatically fill in the transfer purpose as "transfer between accounts under the same person's name" and automatically fill in the counterparty information. The user only needs to confirm and accept the statement.
- Transfer money to your own unmanaged wallet: In this case, there is no need to declare the purpose of the transfer, but the ownership of the wallet must be confirmed. Although the purpose does not need to be stated, such transactions will still be reported to the central bank in a separate classification.
