The European Securities and Markets Authority requires evidence of clearing houses 'disposal of tokenized collateral
The European Securities and Markets Authority (ESMA) wants evidence that clearing houses can access tokenized collateral and convert it into cash when faced with market pressure. On Friday, ESMA issued a public request for opinions aimed at seeking industry feedback on the impact of tokenized collateral.
"We must create the necessary conditions for tokenized markets to operate securely and on a cross-border scale, with legal certainty, interoperability infrastructure, and appropriate regulation." ESMA Chairman Verena Ross said.
As banks and investors seek to obtain securities more quickly to meet margin requirements, tokenized collateral is gradually entering the actual operation of European clearing operations. ESMA's review will help determine whether existing EU regulations can ensure that clearing houses can effectively access and clear such collateral in the event of a member default.
In July 2025, Eurex Clearing introduced collateral services based on distributed ledger technology. JPMorgan Chase executed the first real-time trade for Dutch pension investment fund PGGM to transfer securities from another custody location.
Tokenized collateral faces liquidity and ownership review
The consultation covered tokenized forms of assets held in traditional financial infrastructure, as well as assets issued directly on distributed ledgers. The consultation also examined the interactions between these models and stablecoins, central bank currencies, and tokenized deposits.
ESMA pointed out that even assets that are liquid in traditional forms may face additional risks after tokenization, including delays or transfer restrictions due to redemption procedures.
In addition, ESMA asked whether token transfers confer ownership or enforceable rights on the underlying assets.
Regulatory focus: Priority will be given to promoting AI and tokenization supervision across Europe in 2027
This consultation follows the launch of the Pontes system in September by the euro system. The system allows financial institutions to use central bank currency to settle tokenized asset transactions. ESMA said Pontes could support tokenized collateral arrangements by connecting blockchain-based infrastructure with existing settlement systems.
