Selig said that the FTX incident fully demonstrated the huge damage that can be caused when the market lacks effective protection mechanisms. He pointed out that during the November 2022 crash, operators stole more than $8 billion in customer funds. However, he also specifically mentioned FTX's CFTC registered subsidiary as an exception: because the subsidiary's customer assets are strictly segregated, funds remain safe. This comparative experience constitutes an important basis for Selig's advocacy of federal supervision. He emphasized that the CFTC has broad jurisdiction over cryptocurrency exchanges that provide margin, leverage or financing services. These exchanges must register with the CFTC, but Selig also described the framework as an "optional" system for exchanges to choose voluntarily.
Focus on leveraged trading and build a federal registration system
Currently, many cryptocurrency exchanges rely on state licensing systems to operate. Selig pointed out that some states regard exchanges as money transfer agencies (such as Western Union and PayPal), but he believes such rules do not apply to professional exchanges that handle financial positions and order books. The new federal framework will apply market-based protection mechanisms for registered exchanges. The CFTC issued an advance notice of the proposed rule development on October 5, outlining the federally registered categories covering the cryptocurrency asset market, including the CTX Regulations and the CAM Regulations.
The focus of these proposals is to regulate retail transactions in the form of leverage and margin, while also including reserve certification requirements and anti-manipulation controls. In addition, the proposed framework would also address the role of futures commission merchants in retail transactions and provide exemptions for specific transactions where assets are delivered to non-custodial wallets within 28 days.
The regulatory path is clear and the background for leadership change
Selig has always criticized the practice of "supervision through law enforcement" and pointed out that the Commodity Exchange Act already covers certain digital assets. In fact, as early as 2014, Timothy Massad, then chairman of the CFTC, had identified Bitcoin as a commodity under the jurisdiction of the CFTC. In terms of political background, President Trump nominated Selig as chairman of the CFTC on October 27, 2025, and the Senate confirmed the appointment on December 18 of the same year. Selig officially took office on December 22, 2025. With the departure of Caroline Pham, he became the only formal member of the committee, fully leading the agency's regulatory direction.
