Europe's crypto asset framework takes a critical step: Platform compliance deadline determined

As the EU deadline for cryptocurrency platforms approaches, the European Securities and Markets Authority (ESMA) formally requires cryptocurrency companies in the EU to handle their exposure to stablecoins that do not comply with the Cryptocurrency Markets Regulation (MiCA). This means that national regulators need to oversee the transition process within a specified time frame, while service providers must revisit the many services they provide to European customers.

This measure specifically involves custody, transfer and operation, and aims to prevent the continued holding of tokens that do not comply with European rules.

Summary of Core Points

  • Deadline: ESMA gives European cryptocurrency platforms until January 8, 2027 to deal with issues related to non-compliant stablecoins.
  • Service Restrictions: Companies must stop services related to stablecoins that do not comply with the European framework.
  • Transition period arrangements: During the transition period, customers are still allowed to sell, convert or withdraw their existing positions.
  • Exchange News: Coinbase nobly treats USDT and PYUSD as non-compliant stablecoins and has set an October 30 deadline for its European clients.

MiCA requires phased exit of non-compliant stablecoins

According to ESMA, crypto service providers should stop services related to stablecoins that do not comply with MiCA regulations. National authorities must require relevant companies to resolve their remaining exposures as soon as possible. Although the final deadline set cannot exceed January 8, 2027, regulators can also choose an earlier date.

This position expands the scope of the requirements proposed by ESMA in January 2025. At that time, custody and transfer of certain non-compliant stablecoins might still be allowed. Today, these services can only be extended temporarily, mainly to allow customers to liquidate their existing positions within a regulated framework.

The new guidance covers multiple activities under MiCA supervision, notably trading, client asset custody, transfers, investment advice and portfolio management. Platforms must also prevent their European customers from purchasing non-compliant stablecoins or adding to existing positions.

Three months to process remaining exposure

This timetable gives companies approximately three months to organize exits from affected positions. During this period, national authorities may authorize certain MiCA-related services to allow customers to sell, redeem or withdraw their positions. Under strict regulatory supervision, the company can temporarily continue to custody or transfer these assets.

However, ESMA requires providers to complete this process as quickly as possible. January 8, 2027 is the common deadline announced by European authorities. Nevertheless, national regulators retain the ability to impose earlier cut-off dates under their supervisory frameworks.

ESMA did not name specific tokens in its opinion. On the other hand, Coinbase has determined that Tether's USDT and PayPal USD are stablecoins that do not comply with MiCA regulations. For its customers in the European Economic Area, Coinbase has set October 30 as the withdrawal deadline for affected balances. The remaining amount will then be automatically converted to USDC or other crypto assets or available currencies.

Market adjustments and user responses

This development has also strengthened the distinction between authorized assets and assets that are gradually exiting the European market. Therefore, the platform must adjust its procedures, product offerings and controls to comply with MiCA requirements throughout the transition period.

The new deadline should accelerate the adjustment process of European platforms. Companies need to identify affected positions, notify their customers, and organize authorization actions during the transition period. For users, the current priority is to verify the terms proposed by the affected assets and their platforms. At this point, the implementation of MiCA has entered a more specific stage. As the deadline approaches, the final processing of non-compliant stablecoins is gradually advancing.
