The Commodity Futures Trading Commission (CFTC), the federal agency responsible for overseeing derivatives and some cryptocurrency markets, issued almost the same commitment. Previously, CFTC Chairman Michael Selig said at the agency's Innovation Advisory Committee meeting that regardless of whether Congress takes action, the CFTC will use existing rules to begin building a regulatory system for crypto assets.

Selig instructed employees to draft new rules to establish a dedicated market regulatory structure for cryptocurrency projects. Under the proposed framework, both registered and unregistered trading platforms will be eligible to apply to become a "Designated Contract Market", expanding the scope of regulated activities. In addition, CFTC staff are also required to listen directly to the team behind decentralized financial agreements to develop feasible regulatory processes.

These moves demonstrate that the U.S. government's two main financial regulators are taking a coordinated response while legislative efforts are stalled.

refers to a market venue authorized by the Commodity Futures Trading Commission to provide trading of futures or options contracts and must meet regulatory standards of transparency and fairness.

SEC launches new rulemaking work

Ahead of the Senate vote, the SEC had begun advancing its regulatory agenda. On September 1, the agency proposed updating the regulatory rules for transfer agents, which have not changed since the late 1970s. The new proposal allows registered transfer agents to use blockchain technology as the official ledger of securities ownership, and requires companies to disclose the type of blockchain platform they use and the number of tokenized assets they manage.

Atkins pointed out that although regulatory measures under current law are not as long-lasting as congressional legislation, the SEC and CFTC still intend to provide operational guidance to implement regulation of the digital asset industry.

Through these steps, regulatory clarity for digital assets is gradually shifting from legislation driven to agency driven. Both the SEC and the CFTC are committed to advancing the construction of relevant frameworks through their existing powers.
