Europe wants stablecoins to be removed from the shelves. Where will the tokens held by customers go?

What changes were released by ESMA on October 8?

ESMA's opinion directs national authorities to ensure that crypto-asset service providers authorized by MiCA stop providing services related to non-compliant asset reference tokens and e-currency tokens to EU customers. It covers a wide range of areas, including trading platforms, exchanges, order execution, placement, order receipt and transmission, consultation, transfer, custody, administration and portfolio management. Platforms cannot assume that removing the spot trading pair eliminates all remaining service connections to the token.

This opinion points to narrow exceptions for existing positions. Authorities should request rectification as soon as possible, but no later than three months after release. Ongoing activities are limited to liquidation, conversion, withdrawal, transfer or custody, with time limits and close supervision. Therefore, the platform needs to establish a control system to prevent customers from gaining or increasing risk exposure, while allowing orderly exits.

ESMA issued an "opinion" to national regulators rather than a notice declaring all wallets holding the asset illegal. The document describes the obligations and supervisory expectations of licensed service providers. It should not be reconstructed as an EU-wide confiscation of customer coins or a blanket ban on possession of tokens in private wallets. National authorities must apply expectations to companies under their supervision and decide what to do with outstanding positions.

In January 2025, ESMA and the European Commission issued a statement that addressing may constitute a service that provides or permits token trading and requires compliance before the end of the first quarter of 2025. The October 2026 opinion does not overturn this position; it focuses on a broader range of activities that the company may continue to offer after trading restrictions are implemented.

Which stablecoins are affected?

The key difference is whether it complies with MiCA regulations, not whether the token claims to be worth one dollar. MiCA defines e-currency tokens by reference to a single official currency and asset reference tokens by reference to other values, rights, or combinations. Issuers face requirements for authorization, reserves, governance, disclosure and redemption. Companies evaluating a particular token need to determine its legal classification and issuer status, rather than infer compliance from the code.

USDT is the most obvious example because Tether has not yet received the relevant European authorization. Previous restrictions on USDT on European exchanges have removed ordinary trading channels from licensed venues. Whether other tokens are affected depends on their structure and the status of the issuer. ESMA has not issued a simple list stating that all tokens pegged to the US dollar must be removed on the same day.

The results vary depending on the platform the customer is on: EU licensed exchanges, non-EU services, and personally controlled wallets. ESMA's comments are directed at MiCA-authorized companies that provide services to EU customers. It does not claim to block all transfers on the public blockchain. One token can continue to circulate globally, while licensed European intermediaries restrict customer access to it. This difference is important when headlines describe a currency being banned: the availability of exchange services and the existence of tokens are two different facts.

Holders also need to distinguish between the issuer's redemption commitments and the platform's conversion channels. Direct claims against the issuer depend on token terms and user qualifications. Exchange conversions are transactions based on quoted market prices or platform rates and may involve fees. An unavailable trading pair does not automatically cancel the issuer's obligations, but users who cannot directly redeem may need to rely on intermediaries and liquidity providers to exit.

Can customers choose to withdraw rather than sell?

Withdraws and transfers are functions that ESMA has clearly identified as potentially allowed to clear existing positions. Their inclusion does not guarantee that every platform supports every network or destination. Companies must decide how to allow opt-outs without allowing new customers to enter through other products, accounts or jurisdictions. Its controls may distinguish between existing balances and newly deposited funds.

The "one-way conversion channel" previously provided by OKX Europe demonstrates possible designs. It allows eligible customers to deposit USDT to convert to compliant stablecoins, while ordinary USDT transactions remain restricted. Such channels may serve narrow exit purposes; the October opinion still requires national supervisors to evaluate any ongoing services and their time limits.

Users are responsible for the destination and network for withdrawing funds to self-managed addresses. Wrong chain selection or losing private keys can cause different losses than market conversions. Custody withdrawals also require effective transfer services, as outlined in ESMA's opinion. Companies that immediately shut down transfers could force customers to switch to internal conversions, while companies that accept indefinite deposits could weaken restrictions on increasing exposure. Both options require documented reasonable reasons.

The terms of dormant balances are worthy of attention. Customers may be overseas, unable to complete updated identity verification, or unaware of the exchange's notification. The company needs to clarify whether the remaining balance will be kept in secured custody, converted according to contractual authority, or provided through a subsequent claim process. The custody mentioned by ESMA allows for limited transitions but does not promise unlimited account support. Customers should be able to find actual notices and relevant conversion terms from the platform, rather than assuming that all exchanges follow the same timetable.

What happens to trading pairs?

The USDT's global trading role makes removing ticker symbols more complex than deleting ticker symbols. Many assets are denominated in U.S. dollar stablecoins, which some companies use as margins, clearing units or bridges between venues. European service providers may need to disable order entry, cancel pending orders, recalculate margin collateral, and specify how funds held in portfolio products will be withdrawn. Each feature falls within the broad service categories described by ESMA.

Market makers can route quotes to other stablecoins or fiat pairs, but liquidity is not automatically the same. The spread depends on who is quoting, available inventory and the ability to redeem or move alternative assets. Customers who convert small balances in well-liquid pairs may see little friction; large positions in thin-liquid pairs may encounter significant spreads. Any reported change in market share should distinguish between pairs listed, actual volume and open positions, rather than calculating the number of tokens removed.

Risk control may cause short-term market dislocations. If a venue blocks new purchases but retains a sell function, market makers need to have a path to hedge or redeem the assets they buy. Otherwise, one-way markets may become illiquid or cheaper than relevant global venues. Platforms can impose size limits or use approved liquidity partners. The final customer result depends on the quality of execution, not just whether the exit button appears.

Customers cannot assume that non-EU platforms provide permanent workarounds. Services accessed through overseas websites may still face local rules when targeting EU residents. Conversely, users who sent tokens to independent blockchain wallets did not find a regulated European cash withdrawal channel. Availability of technical transfers and legal access to specific services are two separate issues.

Regulators 'ability to monitor compliance is partially observable. It can check the licensed company's onboarding process, product screens, internal policies and transaction records. It cannot infer the legal status of each customer from the public chain address, especially when the holder is unknown. Therefore, company-level control is the direct point of law enforcement.

Can replacing stablecoins solve the problem?

MiCA-authorized issuance provides a regulatory avenue for licensed European platforms, but does not eliminate payment, custody or market risks. Users must evaluate the issuer, redemption terms, reserve disclosures, and the network from which the token was issued. Converting from USDT to USDC, EURC or other qualifying assets changes the issuer and may change currency exposure. For euro-denominated customers, euro tokens and U.S. dollar tokens have different exchange rate risks.

Circle's MiCA-related expansion in Europe demonstrates a path for issuers seeking authorization. AllUnity's U.S. dollar stablecoin release demonstrates another path. Neither announcement establishes a commitment for each exchange to have deep order books or cheap conversions for specific customers. Issuer authorization, listing and available liquidity are separate stages.

If a small number of compliant issuers receive traffic from most regulated venues, concentration may become a policy issue. Competition depends on feasible reserve rules, access to bank partners and the cost of maintaining authorizations. Circle's recent request to revise MiCA reserve deposit requirements suggests compliance firms are still debating the design of the system. Customers can obtain more clearly regulated tokens, but their market remains concentrated.

Convertions should be reported in their actual terms. One unit of a U.S. dollar stablecoin is designed to equal one dollar, but secondary prices, fees and spreads may differ. Exchanges may quote a substitute token against another token, settle in euros, or use intermediaries. Marketing language about seamless migration is no substitute for displaying rates and fees at execution.

Where are private wallets and decentralized markets?

Tokens extracted into self-managed wallets may still be transferable on their underlying blockchain. ESMA's October filing targets authorized crypto service providers, including their transfer and custody services. It does not grant the platform the right to continue to provide ordinary access simply because the user's final destination is a private wallet. The company remains responsible for its own part of the transaction.

Decentralized transactions introduce border issues. Users can interact with the protocol through software rather than through an identifiable licensed broker. MiCA's handling of activities conducted in a completely decentralized manner is controversial, with real interfaces that may include companies, operators or intermediaries. The existence of a decentralized route should not be described as an exemption for any other company that falls within the scope of MiCA. A possible transition to such venues does not prove that all European users are following the same path.

The actual danger is fragmentation. A token may remain the main liquid asset in global or decentralized markets and disappear from the order book of MiCA authorized providers. Customers moving between these markets face additional network, counterparty and execution options. Regulated exit channels can reduce confusion if platforms publish clear deadlines and supported destinations before disabling features.

What should the customer notification explain?

Useful notices should list the tokens and networks affected, services ended, the date of each change, and whether existing balances can be sold, converted, or withdrawn. It should explain what happens to funds in pending orders, collateral, regular purchases and associated products. It should disclose conversion mechanisms, fees and how to challenge unexpected execution or contact support.

Companies should specify whether deposits are only accepted for conversion and whether users can choose to replace assets. If account terms authorize automatic conversions, customers need to know the source of the rates and times. Revolut's previous USDT delisting notice demonstrated how the platform announced automated processing of remaining positions. A provider's policies should not be summarized as EU requirements.

Records after the deadline are important. Users may require the original acquisition cost, conversion date, quantity and fees for tax reporting or account disputes. Companies that disable products should retain a downloadable transaction history and clarify whether old reports are still accessible. In a few months, MiCA's market access issues could turn into mundane records issues for customers.

Complaint processing may cross borders. Customers residing in one Member State may use companies authorized in another State. The service provider's legal entities and national authorities should be identifiable in the account terms. ESMA's opinion seeks consistency, but it does not create a single EU customer service desk for every lost transfer or controversial conversion.

How much liquidity can be moved in three months?

The trading volume of stablecoin advertised by the exchange is not equal to the balance of customers still waiting for rectification. A trading pair can turn around multiple times in a day, but its end-of-day inventory may be small. Conversely, dormant custody balances can be large, even though they are almost invisible in transaction data. The first useful measure will be each company's affected customers 'holdings of inventory and the amount that has been converted or withdrawn, preferably separated from its own balances and market maker inventory. ESMA did not provide such EU totals in its opinion.

Rapid migration may create concentrated demand for a limited number of compliant alternatives. Issuers may need to forge new supplies of incoming funds, while exchanges and liquidity providers need to fund inventory before customer orders arrive. Weekend bank hours, redemption deadlines and chain congestion may change settlement speeds. The existence of an adequate supply of total stablecoins does not guarantee that a particular exchange will be able to quote large conversions on demand at narrow spreads.

Slower migration can reduce sudden squeeze but prolong customer uncertainty. The platform may issue notices in stages to immediately close new positions and maintain a carefully limited exit window. Regulators can compare residual risk exposure to the company's deadline plan. A trapped account balance after the final withdrawal date will be a more specific consumer result than the platform announced the end of normal transactions several months ago.

Another potential cost is tax and reporting complexity. Converting stablecoins into fiat currencies, exchanging them into tokens from different issuers, and withdrawing them into private wallets may have different reported consequences depending on customer countries and circumstances. The ESMA document establishes market regulation rather than uniform EU tax treatment for each exit option. Customer guidance should avoid implying that conversions are tax-free simply because both instruments target the same currency.

Will the rules change again?

MiCA is an implementation framework, but its implementation is being debated by lawmakers and regulators. ESMA recently called for further changes to clarify MiCA, including the treatment of emerging services. Issuers have raised concerns about reserve requirements and cross-border access. Proposal or policy debate will not suspend October opinions. Licensed companies must operate in accordance with current rules when any amendment is followed by their own procedures.

The European method has two different clocks. The instant clock is a gradual exit from the supervised exposure to remaining non-compliant services. The longer clock concerns whether the issuer is qualified, reorganized, or enters the market with a newly licensed product. If the issuer is subsequently authorized, the provider must still evaluate listing, operational readiness and customer qualifications. Readers should not infer from policy discussions that affected trading pairs will quietly reopen tomorrow.
