XRP Cryptocurrency researcher SMQKE announces SEC/CFTC official rulemaking timetable for digital assets
Cryptocurrency researcher SMQKE (@SMQKEDQG) shared a regulatory timeline on the U.S. Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC) official rulemaking for digital assets. The timeline shows that the joint rulemaking phase is expected to be completed between the end of 2026 and 2027, with full implementation scheduled for early 2027. For XRP holders and exchanges, the countdown has begun.
The timeline and what it reveals
The timeline released by SMQKE traces the legislative process from the Senate committee mark (originally planned to begin in mid-March 2026) to full compliance. The form predicts that if passed by the full Senate, the bill will be sent to the president for signature in April or May 2026. If the president signs it in June 2026, it will trigger a "temporary registration" period, during which the exchange can register with the CFTC to avoid enforcement action.
Two of the highlights are the most critical:
- Joint rule-making period : It is expected that between the end of 2026 and 2027, the SEC and the CFTC will be required to finalize joint rules on token classification and custody.
- Full implementation : Scheduled for early 2027, this will end the 18-month grace period after which all platforms must achieve full compliance.

The timeline released by SMQKE is based on the assumption of legislative success. However, the CLARITY bill failed to receive the Senate cloture vote on September 15, failing to reach the required 60 votes in support by 11 votes. All Democratic lawmakers present voted against it.
Despite the bill's failure, regulators have not stopped acting. SEC Chairman Paul Atkins said the agency will move forward within its legal authority. The CFTC has taken the same position. Within days of the vote, both agencies acted quickly:
- The SEC issued an innovation exemption clause on September 17, opening up a five-year conditional path for tokenized stock trading.
- The CFTC issued a non-enforcement position statement against passive software providers on the same day.
- The SEC proposed crypto asset custody rules for investment advisers on October 1.
Regulators are building a system of rules through exemptions, proposals and guidance documents rather than relying on legislation. Although the goal remains unchanged, the path to achievement has changed.
XRP and Joint Rulemaking Window
XRP is one of 16 assets classified as digital commodities determined by a joint SEC/CFTC interpretation in March 2026. The upcoming joint rulemaking period will determine how custody requirements are enforced and how token classification rules apply.
